The second video in our series, it focuses on the 2011 case of SJRWMD v Koonyz in which the court invalidated a number of lower court decisions that stated the St. Johns River Water Management District (SJRWMD) had effectively stolen private property from the Koontz’s. The family was awarded $367,000 in damages but the Supreme Court overturned that ruling saying that it could cause government regulation to cost too much.

Our courts are supposed to protect our rights.

The legislature passed a proposed constitutional amendment during the 2010 session that would have placed the Healthcare Freedom Amendment on the November 2010 ballot, however the justices removed that amendment from the ballot, citing “misleading” language. Rather than allowing the description to be re-written, they struck it out entirely and left us with no chance to exercise the fundamental right to a vote.

Are the Florida supreme court justices working in our best interest? You be the judge.

In 2009 -2010, the debate over health care reform got heated. But that is what we do in America, we debate and listen to all sides of the issue. Almost everyone agreed something had to be done, but there was disagreement on just what that reform would look like. Even today, most Americans oppose the new health care law. This is why states began to allow the people to decide. States like Ohio and Arizona put the issue on the ballot, giving their citizens a voice and a vote.

But Florida denied us that right. In 2010, the legislature voted to allow put an amendment on the ballot that gave Floridians the right to vote on how much control government and Washington bureaucrats will have on our health care. But, the Florida Supreme Court removed this amendment from the ballot, stripping us of the most basic right we have as citizens, the right to vote.

Shouldn’t Florida’s courts be above petty politics? Shouldn’t Florida’s Supreme Court strive to protect the rights of its citizens first?
